四川省人民政府贯彻实施《社会保险费征缴暂行办法》意见的通知
四川省人民政府
《社会保险费征缴暂行条例》(国务院令第259号,以下简称《条例》)已发布实施,这是我国社会保险法制建设的重大举措。为了贯彻实施好《条例》,现结合我省实际,提出如下贯彻意见,请一并贯彻执行。
一、四川省行政区域内基本养老保险费、基本医疗保险费、失业保险费、工伤保险费和生育保险费(以下统称社会保险费)的征收、缴纳,适用该《条例》。
二、全省各级社会保险经办机构为社会保险经费的征收机构。
社会保险费征收办法,由省劳动厅会同有关部门另行制定。
三、全省各级社会保险经办机构,统一办理缴费单位和缴费个人有关社会保险的登记、申报等事宜,以方便登记和申报。缴费单位或缴费个人登记、申报的内容、程序,由省劳动厅根据劳动和社会保保障部的规定另行制定具体办法。
四、工伤保险费和生育保险费的征缴范围是:国有企业城镇集体企业、外商投资企业、城镇私营企业等。工伤保险费的征缴范围还包括乡镇企业。基本养老保险费的征缴范围,除《条例》规定外,还包括城镇个体工商户及其雇工。失业保险费的征缴范围,除《条例》规定外,还包括机
关劳动合同制工人、社会团体及其专职人员、民办非企业单位及其职工。有条件的地区,可逐步将有雇工的城镇个体工商户及其雇工纳入失业保险的范围。
五、社会保险费实行财政专户储存、收支两条线管理,管理、运行和拨付的具体办法,由省劳动厅会同省财政厅和人民银行成都分行别行制定。
六、社会保险费实行按月缴纳。个体工商户是否实行按月缴纳,由各地自行规定。缴费单位按月申报的社会保险费数额,按省政府及各市、地、州政府(行署)关于各项费率、费基的当年具体规定计算,经社会保险经办机构核定后按期缴纳。
七、社会保险登记证件按照劳动和社会保障部的统一式样,由省和市、地、州劳动保障部门发放。省劳动厅负责直管单位和企业,市、地、州劳动保障部门负责本辖区内的单位和企业。
八、要努力扩大社会保险的覆盖面。各级人民政府要按照《条例》和今年的工作目标,努力扩大社会保险,特别是养老保险、失业保险的覆盖面。覆盖范围内的缴费单位或缴费个人,必须依法进行社会保险登记,参加社会保险。拒不进行登记参加社会保险的,各级劳动保障部门要依法
进行查处。各级工商行政管理部门要把依法参加社会保险作为企业和个人体工商户营业执照年检的必备条件之一,对没有参加社会保险的企业和个体工商户,不予办理工农业执照的年检。
九、要进一步提高社会保险费的征收率。各级人民政府和有关部门要以贯彻《条例》为契机,采取有力措施,按照年度目标责任制的要求,进一步提高社会保险费的征收率。对不如实申报缴费数额的,各级劳动社会保障部门要进行审计稽核;对有能力缴纳而拖欠或抿不缴纳的,要坚决
按照《条例》的有关规定,采取行政的、经济的、法律的手段予以查处;对未缴纳社会保险费的,社会保险经办机构可以暂停支付医疗保险、工伤保险和生育保险费。对拖欠社会保险费的典型案件,要予以曝光。对国有单位拖欠社会保险费的,单位领导和管理人员不得出国考察和晋级增薪
,单位和领导不得评选先进,单位不得购买小汽车。对拖欠严重的,组织人事部门要采取组织措施。

This Ordinance may be cited as the Money Lenders Ordinance.
This Ordinance shall have effect notwithstanding any agreement

PART II LICENSING OF MONEY LENDERS

No person shall carry on business as a money lender--
without a licence;
at any place other than the premises specified in such licence;

An application for a licence shall be made to the Registrar in

Where an application is lodged under section 9 (5), the

Where under this Ordinance the licensing court is required

各县市区人民政府,市政府各部门:
《十堰市建筑节能试点示范工程管理办法》已经市人民政府同意,现印发给你们,请认真贯彻执行。

十堰市建筑节能试点示范工程管理办法
第一条 为认真贯彻科学发展观和可持续发展战略,落实节约资源基本国策,增强公众的节能意识,大力推广节能产品和技术的应用,推进建筑节能标准实施,根据《民用建筑节能管理规定》(建设部第143号令)、《建设部建筑节能试点示范工程(小区)管理办法》(建科〔2004〕25号)和《湖北省建筑节能管理办法》(省政府第281号令),结合我市实际,制定本办法。
第二条 本办法所称建筑节能示范工程(以下简称示范工程),是指按照《夏热冬冷地区居住建筑节能设计标准》(JGJ134-2001)、《住宅建筑规范》(GB50368-2005)、《公共建筑节能设计标准》(GB50189-2005)和湖北省《居住建筑节能设计标准》(DB42/301-2005)组织建设,经竣工验收合格,并由市建设委员会公布的工程。
第三条 市建设委员会负责示范工程的立项审查与批准实施、建筑节能专项竣工验收核验、建筑节能示范工程称号的授予工作。市墙体材料改革与建筑节能办公室和质量监督部门负责示范工程的日常监督。
第四条 十堰市行政区域内(包括县、市)的民用建筑工程项目,符合本办法规定的,均可申报示范工程。
第五条 示范工程应重点采用下列成套节能技术和产品:
(一)新型节能墙体、保温隔热屋面、节能门窗、活动遮阳等节能技术与产品。
(二)供热采暖系统调控与热计量和空调制冷节能技术与产品。
(三)太阳能、地下能源和沼气等可再生能源。
(四)建筑照明的节能技术与产品。
(五)其它技术成熟、效果显著的节能技术,"节水、节地、节材"技术和节能管理技术。
第六条 申报示范工程的项目必须具备以下条件:
(一)有规划、建筑设计方案和节能专项设计方案。
(二)有建设项目的立项手续。
(三)有可靠的资金来源。开发企业应有相应的房地产开发资质。
(四)选用的节能技术与产品通过有关部门的认证和推广,并符合国家、省(或行业)标准。
(五)住宅小区建筑面积15000m2以上,单体住宅建筑面积5000m2以上;公共建筑建筑面积4000m2以上。
第七条 申报示范工程的单位应提交以下文件、资料:
(一)十堰市建筑节能试点示范工程建设项目申报书。
(二)工程可行性研究报告(含节能篇)。
(三)规划、建筑设计方案和节能专项设计方案。
(四)工程立项批复。开发企业的房地产开发资质。
第八条 示范工程的组织实施。
(一)项目申报。
申请示范工程的单位在规划设计阶段向市建设委员会提出申请,填写《十堰市建筑节能示范工程项目申报书》,并将有关文件、资料一并报十堰市建设委员会。各县(市)工程项目,由当地建设行政管理部门初审后,统一报送市建设委员会。
(二)立项认定。
市建设委员会组织成立技术审查机构,负责对申报项目及相关技术资料进行审查。凡建筑节能专项技术设计方案经审查并认可,施工图设计文件通过技术性审查并备案的工程项目,由市建设委员会认定,列入试点示范工程实施计划,在项目实施地加挂"十堰市建筑节能示范工程实施项目"标牌。
(三)建设管理。
1、建设单位要成立由建设单位、监理单位、施工单位的技术负责人组成的示范工程管理专班,制定示范工程实施方案,明确各自的职责,确保示范工程项目的顺利实施。
2、示范工程项目要严格按照示范工程实施方案实施。建设单位应责成监理单位对实施建筑节能的关键工序、关键材料、关键设备进行重点监督,并组织监理单位和施工单位整理工程节能实施的技术资料档案。
3、档案资料主要包括:主要墙体材料、屋面材料、屋面保温隔热材料的热惰性能检测报告;门窗的传热系数及气密性、水密性、抗风压强度的检测报告;节能产品的说明书和推广使用证;太阳能和地下能源节能技术可行性研究报告;建筑节能的施工资料及专项验收资料。
(四)工程检查。
列入示范工程实施计划的项目,建设单位要于开工后每三个月向市墙革与建筑节能办公室报告工程进展和实施情况。质量监督部门和墙革与节能办,重点检查已批准的建筑节能设计施工要求和技术要点在工程中的具体实施达标情况,负责建筑节能分项工程的核查和验收。
第九条 示范工程竣工后,由建设单位向市建设委员会提出专项验收申请,待建筑节能专项核查验收合格后,对专项验收资料进行整理并报市建设委员会备案。县(市)工程应通过项目所在地建设行政主管部门组织的初验,初验合格后,建设单位向市建设委员会提出竣工验收申请。
第十条 对建筑节能专项验收合格和工程项目竣工验收合格并备案的工程,市建设委员会将在十堰建设和管理信息网及有关媒体上公示,公示时间为七个工作日。公示结果无异议的工程,由市建设委员会统一公布,并颁发"十堰市建筑节能示范工程"证书和标志。
第十一条 示范工程标志应镶贴在示范工程的主要出入口。任何单位和个人未经同意,不得擅自使用"十堰市建筑节能示范工程"标识和标志。
第十二条 凡列入示范工程项目计划,并经市建委核查验收合格的项目,全额返退墙改专项基金,并享受国家建筑节能有关优惠政策。
第十三条 在实施过程中出现下列情形之一的项目,取消其示范资格,并予以公示。
(一)未按规定的程序和要求组织实施的;
(二)工程项目的节能关键工序、关键材料、关键设备未达到建筑节能技术标准;
(三)列入计划后一年内未组织实施的;
(四)工程竣工后两年内未申请节能专项验收的。
第十四条 本办法由市建设委员会负责解释。
第十五条 本办法自发布之日起施行,如法律法规有新的规定,本办法与其有冲突的内容,按新的规定执行。
